Divorce is at the interim stage and hopeful final judgement will be issued by end May. Have requested to include in the decree he will be liable to pay up the debt incur by him, but no payment was ever made by him. How do i make him follow the court order? Anyway I can make him take over the debts and remove my name?
Joint account bank debt incurred by ex before divorce. How can I transfer the amount to him?
If it is a joint account, you obviously signed as a 'co-owner' of the debt when the debt was incurred. That makes you both responsible parties, individually and jointly. If the money borrowed was used exclusively by your ex, and you can prove it, speak to your attorney about having the divorce decree include a clause that your ex will be solely responsible for the debt. Of course, that does not mean that your ex will willingly sign such a decree. If there is a court order already in place that orders him to make the payments, the ex is already in contempt by not making payments. Speak to your divorce attorney about this complicated matter.
Good luck.
Reply:First, you cannot do anything to make him follow an order. If it was ordered in the divorce decree that he was supposed to repay this debt and take over the debts then you need to contact the court and let them know he is in contempt - he is directly ignoring a court order....bad juju. They will handle it from there.
